Welcome to Proglass.co.uk. Proglass.co.uk provide access to the Proglass.co.uk website (the "website") and sell our products to you subject to the conditions set out on this page.

Please read these conditions carefully before using the Proglass.co.uk website. By using the Proglass.co.uk website, you signify your agreement to be bound by these conditions. In addition, when you use any current or future Proglass.co.uk service, you will also be subject to the terms, guidelines and conditions applicable to that service. ("Terms"). If these Conditions of Use & Sale are inconsistent with such Terms, the Terms will control.

Conditions Relating to Your Use of Proglass.co.uk

If you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. Proglass.co.uk reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

The information you provide on this online store will be held by Proglass and not by any third parties.

The information you provide on this site may be held and used by us for any of the following purposes: order processing, administration of customers' orders and/or accounts, dealing with enquiries or complaints, crime and fraud prevention, marketing our products and services generally or (subject to any objection or preference you may indicate when submitting your personal details to us via this Website) for sending information to you about our products from time to time. In addition, and where you have specifically granted consent for us to do so, we may use information about you provided by credit reference agencies to help us make credit decisions and to prevent fraud.

4. Access to Proglass.co.uk

We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. All content included on the website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Proglass.co.uk. The compilation of all content on this website is the exclusive property of Proglass.co.uk. All software used on this website is the property of Proglass.co.uk.

You may not systematically extract and/or re-utilise parts of the contents of the website without Proglass.co.uk's express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this website, without Proglass.co.uk's express written consent. Proglass's trademarks and trade dress may not be used in connection with any product or service that is not Proglass's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Proglass. All other trademarks not owned by Proglass that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to, Proglass.

13. Retention of Title

Ownership of the goods shall remain with Proglass and shall not pass to the Customer until the agreed price for them, together with all other sums due from the Customer to Proglass, have been paid in full.

14. Our contract

When you place an order to purchase a product from Proglass.co.uk, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we've dispatched that product to you (the "Dispatch Confirmation E-mail"). That acceptance will be complete at the time we send the Dispatch Confirmation E-mail to you. Any products on the same order which we have not confirmed in a Dispatch Confirmation E-mail to have been dispatched do not form part of that contract.

15. RETURN POLICY FOR DAMAGED OR DEFECTIVE PRODUCTS

Subject to any specific warranties we offer in relation to particular products, or those which are implied by law, we do not offer any warranty or guarantee on our products.
You should inspect the product(s) when you receive them for defects or damage. Once received, goods which are not of satisfactory quality, not as described or simply unwanted may be returned for a full refund. Simply return the items, in their original condition and packaging as far as possible, within 28 days of receipt. You must ensure that you take reasonable care of the Product(s). Please note, that the initial postage and packaging charge is non-refundable for any unsuitable items
If the product(s) are found to be damaged prior to delivery to you, or defective (through no fault of your own wearing or use), we will repair or replace the product(s) or refund the price paid by you, including any delivery charges you paid, provided that you have not worn or used and damaged the product(s).

16. Pricing and availability

We list availability information for products sold by us on the website, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, we will inform you by e-mail if any products you order turn out to be unavailable.

If a product is mispriced on our website then Proglass reserve the right to cancel the order and will, at our discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation.

All prices are inclusive of VAT unless stated otherwise.

17. Customs

When ordering goods from Proglass.co.uk for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Proglass.co.uk, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

18. Advice Provided

If we provide you with any advice on products or DIY tasks then this is provided for general information and background, it should not be relied upon as the sole information on how to use a product or complete a task.

Before commencing any DIY task please:

  • Assess the risks associated with what you are about to do – taking any necessary precautions; and
  • Read and follow all manufacturer’s instructions relating to the equipment, products or task you are about to use.

If you are in any doubt, please stop and seek advice from a professional. The tasks shown should not be attempted by the under 18s or the inexperienced. Some tasks such as work involving gas, electricity or water should only be carried out by qualified professionals.

To the extent permitted by law, Proglass accepts no liability for any loss, damage or injury arising as a consequence of the advice provided.

18. Health & Safety Guidelines

Certain products have properties that make them potentially unsafe if misused. You must, upon receipt of any product, read carefully any safety warnings and follow clearly any guidelines on how to use the product. If you are in any doubt about the use of the product, the meaning of any warnings, or whether your intended use of the product is safe, we urge you to contact the manufacturer for clarification prior to use. Proglass.co.uk will not be held responsible for any negligent use or misuse of products purchased from our website. Nothing in these guidelines should be thought to supersede, or to alter, or to take precedence over manufacturers' instructions. If no instructions are issued and you have a query about how to use the product you are purchasing, we request that you consult the manufacturer.

Some examples of product categories where safety precautions may be appropriate are listed below, for information purposes only.

Hazardous Substances

Manufactured goods falling into these categories will have appropriate labelling, warning information and advice on treatment should accidents occur. Hazardous substances are graded "irritant", "corrosive", "harmful", "toxic" or "poison".

Fume, Mist or Vapour

Certain products may produce fumes, mist or vapour. Before using any product that may produce fumes, mist or vapour a suitable risk assessment must be carried out and necessary precautions taken. Typical precautions will include (but are not limited to) ensuring appropriate ventilation in the work area and the wearing of suitable protective clothing, such as dust-filtering masks or charcoal-based vapour filters.

Tools

Tools can be dangerous if incorrectly used or abused. You must ensure that, when using tools, you take practical precautions to avoid accidents, including the following:

  • keep tools securely held and ensure that when working with tools the operator has a good firm foothold, is well balanced and the floor is clean
  • always use the right tool for the job. Only use tools for the purpose for which they were designed. Always use the right size tool
  • when using a cutting tool, such as a saw, take particular care to ensure that the workpiece is held in a vice or clamp
  • keep your free hand well away from the cutting edge of the tool
  • always keep cutting tools guarded when not in use, or when being transported
  • always be careful with any striking tool to use the appropriate tool for the job. For example, only using a club hammer to drive cold chisels and only using a mallet to drive wood chisels
  • protect your body from the tool and, where relevant, from any flying shards or chips produced by using the tool
  • use protective eyegear

Electrical Products

A standard electric motor is designed for one voltage only. Always check that the power supply corresponds to the voltage on the rating plate. Do not attempt to operate a 115-volt motor on a 240-volt supply or vice versa.

If an extension cable is required, use an approved extension cable suitable for the power input of the machine. When using a cable reel, always unwind the cable completely.

Ensure any plug is fitted correctly. If in doubt ask a qualified electrician to do it for you. Ensure that the correctly rated fuse is fitted to the plug to suit the power tool or appliance being used.

Never use an electric tool without ensuring that you have read the instructions issued by the manufacturer. If they are missing, ask the manufacturer to supply them to you before you begin using the tool.

When using an electrical tool (particularly outdoors) use a residual current device (circuit breaker or RCD) for enhanced protection.

Aerosols

  • store in a cool place out of direct light
  • never puncture a container
  • never incinerate a container either when full or empty
  • follow maker's instructions written on the container
  • do not smoke or use near any source of ignition

Cleaning Agents

There are hazards with most cleaning agents. Some cleaning agents may cause severe hand complaints. Others are flammable and many can become toxic under certain circumstances. You must follow carefully the instructions provided with cleaning agents and check if gloves are applicable.

  • do not use in confined spaces
  • always wear a mask or respirator
  • never mix two different cleaning agents or solvents together
  • do not smoke or use near any source of ignition

19. Children

Proglass.co.uk does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use Proglass.co.uk only with the involvement of a parent or guardian.

21. Electronic communications

When you visit Proglass.co.uk or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

22. Losses

Proglass.co.uk will be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you commenced using the website, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed. Proglass.co.uk does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or wilful misconduct.

23. Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and Conditions of Conditions of Use & Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

24. Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

25. Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

26. Governing law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

Notice and Procedure for Making Claims of Infringement

We respond expeditiously to intellectual property rights owners who complete and submit an email to info@proglass.co.uk to communicate concerns of any alleged infringement.

Upon receipt of an email setting out the purported infringement claim we may take certain actions, including removing information or an item, all of which are taken without any admission as to liability and without prejudice to any rights, remedies or defenses, all of which are expressly reserved. Furthermore, in submitting this email, you grant to Proglass.co.uk the right to use, reproduce, modify, adapt, publish, translate, create derivative works from, and display its content throughout the world in any media. This includes forwarding the email to the parties involved in the provision of the allegedly infringing content. You agree to indemnify Proglass.co.uk for all claims brought by a third party against Proglass.co.uk arising out of or in connection with the submission of the email.
